You must be at least 18 years old to use Ifounder. By creating an account, you confirm that you meet this requirement.

Business Use

If you use Ifounder on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Product Description (SPS Assessment)

Ifounder provides an AI-powered diagnostic tool that evaluates your business capabilities across three dimensions:

• Strategy: Your ability to set clear direction and make effective decisions
• Persuasion: Your capacity to communicate, influence, and build relationships
• Systems: Your proficiency in creating processes, structure, and operational efficiency

How It Works

• Complete 30 diagnostic questions across the three SPS dimensions
• Automated scoring calculates your strengths and weaknesses
• AI-generated analysis creates personalized insights
• Receive a comprehensive report with recommendations and action plans

Important Limitations

The SPS Assessment provides guidance for learning and decision support only. Results are not guarantees of business success. Use the insights as one input among many when making business decisions.

4. AI & Content Disclaimers

AI-Generated Content

Your diagnostic report is generated using artificial intelligence (OpenAI's GPT models). While we strive for accuracy and relevance, AI-generated outputs:

• May contain inaccuracies, omissions, or outdated information
• May not apply perfectly to your unique situation
• Should be evaluated critically and verified independently
• Are based on patterns from training data, not personalized expertise

Ifounder does not provide legal, medical, financial, or professional advice. The SPS Assessment and reports are educational tools for self-reflection. You are solely responsible for how you interpret and act on the information provided.

5. Payments, Plans & Refunds

Pricing

Ifounder operates on a pay-per-report model. Each SPS Assessment costs $9.97. Pricing is subject to change with notice.

Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms and privacy policy.

Refund Policy

All sales are final. Due to immediate delivery of digital assessment reports, we do not offer refunds except in cases of technical error preventing report generation. Contact us at support@ifounder.io within 7 days if you experience technical issues.

6. Intellectual Property

Our Rights

Ifounder retains all intellectual property rights in the SPS Framework, assessment questions, scoring algorithms, software, platform, logos, branding, and all website content.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Ifounder for its intended purpose. This license does not include rights to modify, distribute, or create derivative works.

Your Content

You retain ownership of your assessment responses. By using Ifounder, you grant us a limited license to process your responses to generate your report, analyze anonymized data to improve our framework, and store your data for future access.

We never sell your individual assessment data to third parties.

7. Data & Privacy

We collect account information, assessment responses, payment information (via Stripe), and technical data to operate our service.

We use this data to generate your personalized report, improve assessment accuracy, communicate updates, and maintain security.

Third-party services we use:

• OpenAI: AI processing for report generation
• Stripe: Secure payment processing
• Replit: Cloud hosting and data storage

8. Availability & Changes to Service

We strive to keep Ifounder available and functional, but cannot guarantee uninterrupted access. We reserve the right to modify, update, or discontinue features at any time, perform maintenance, improve the assessment methodology, and adjust pricing with notice.

9. Limitation of Liability

Ifounder is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We disclaim all warranties including merchantability, fitness for a particular purpose, accuracy of content, and uninterrupted operation.

To the maximum extent permitted by law, Ifounder shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, business interruption, or reputational harm.

Damage Cap: Our total liability for any claims shall not exceed the greater of $100 or the amount you paid in the three months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Ifounder from any claims, damages, losses, and expenses (including attorney fees) arising from your violation of these Terms, misuse of the platform, infringement of third-party rights, or violation of applicable laws.

11. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

Informal Resolution

Before initiating legal action, please contact us at support@ifounder.io to attempt informal resolution.

Binding Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. Arbitration will take place in California, and the arbitrator's decision is final and binding.

Class Action Waiver

Dispute resolution proceedings will be conducted on an individual basis, not as part of a class, consolidated, or representative action.

12. Changes to These Terms

We may update these Terms to reflect changes in our service, legal requirements, or to improve clarity. When we make changes, we will update the "Last Updated" date and notify you via email for significant changes.

Continued use of Ifounder after changes take effect constitutes acceptance of the updated Terms.
